Droit Au Logement Opposable (DALO) appeals

If you are in the process of applying for social housing but have not received a suitable offer, the DALO appeal may enable you, subject to certain conditions and availability, to be allocated social housing as a matter of urgency.

Here are the different situations in which you can take advantage of this remedy:

  • No response or negative response to your application for social housing, or an abnormally long allocation period. This differs according to the geographical location of the social housing application and is set by the Prefect;
  • Be homeless or threatened with eviction with no possibility of rehousing;
  • You must have been living in accommodation or in a social hotel residence (RHVS) continuously for more than 6 months or have been living temporarily in transitional accommodation or in a hostel for more than 18 months;
  • Being housed in premises that are unfit for habitation, unfit for habitation, unhealthy or dangerous, or being housed in a dwelling that does not have the obligatory equipment and comforts (no heating, no drinking water, etc.). All of this is conditional on having at least one minor child or disabled person as a dependant, or having a disability yourself;
  • Be housed in accommodation with a living area of no more than 16 m2 for a household without children or 2 people. This area is increased by 9 m2 for each additional person, up to a maximum of 70 m2 for 8 people or more. All this is subject to having at least one dependent minor child or disabled person, or being disabled oneself.

How do you go about it?

To make a DALO appeal : 

The application should be sent to the secretariat of the DALO mediation commission in the department in which you wish to obtain social housing:

  • Or submit the appeal directly to the Commission secretariat
  • Or send the appeal to the Commission secretariat by registered letter with acknowledgement of receipt

Deadlines

The commission must render its decision within 3 months from the date of acknowledgement of receipt of your DALO appeal. After this deadline, if no suitable proposal has been made, it is possible to appeal to the administrative court within 4 months. The administrative court will have 2 months to respond.

Warning: you must renew your social housing application (and update it if necessary), until a home is allocated.
